"Chief Justice Gersdorf didn't change her mind and she's still convinced that her tenure expires in 2020. On Monday, she's going on vacation. As far as I know, she didn't sign any official documents after 3 July," Supreme Court's spokesperson, Marek Laskowski said on Friday.
Unchanged standpoint
"According to President's decision, 14 Supreme Court judges entered into retirement on July 4. The First President Małgorzata Gersdorf received the same kind of document, however in her case, the situation is of extraordinary nature," said spokesperson for the Supreme Court, judge Michał Laskowski.
Mr Laskowski said at a press conference, that the Chancellery of the President has sent official documents to the Supreme Court, informing about retirement of judges starting on July 4.
"As regards judge Gersdorf, her situation is different than that of other Supreme Court judges, and therefore our standpoint on this matter remains unchanged," said judge Laskowski.
Current numbers
As he said, including judge Gersdorf, there are 59 judges in the Supreme Court at the moment.
Only that 55 are currently giving rulings bacause "along with judge Gersdorf there are three other judges who have sumbitted to the National Judiciary Council, separate statements pointing to the Constitution".
Until this procedure is pending, all four remain judges but they are not assigned to trials and they cannot hand down rulings," explained Laskowski.
Spokesperson of the Supreme Court also informed that there were two visits in the Supreme Court on Friday.
One by Amnesty International representatives, including its Secretary General, and the other by judiciary organizations of "European caliber".
The latter delegation included the President of the European Network of Judiciary Councils (ENCJ), the Chairman of the Network of the Presidents of the Supreme Judicial Courts of the EE, and representative of the Consultative Council of European Judges (CCEJ).
