Judge Małgorzata Gersdorf, in accordance with the Constitution, remains the First President of the Supreme Court until 30 April 2020 - reads the resolution adopted on Thursday by the General Assembly of Supreme Court Judges.
The Supreme Court's spokesperson, judge Michał Laskowski announced after the General Assembly on Thursday that 63 judges that took part in the meeting unanimously adopted two resolutions.
"We, the judges of the Supreme Court present at the General Assembly on the 28th June 2018, bearing in mind our plegdes and the Constitution which is the ultimate law in Poland, hereby state that judge Małgorzata Gersdorf, in accordance with Article 183 Paragraph 3 of the Constitution, remains until 30 April 2020 the First President of the Supreme Court, the institution in which we fulfill our duty of service to the people," reads the resolution.
"We state that a clear, categorical and absolute norm stemming directly from the Constitution cannot be changed with a legislation. The tenure of the First President of the Supreme Court has been regulated in the Constitution and therefore, according to the regulation, it is forbidden to change this matter by means of legislation, as any new act must be constituitonal," added judge Laskowski.
