Allegations regarding Łukasz Piebiak's involvement in the hate campaign call for an immediate ban on serving as a judge - reads a resolution adopted by the Council of the District Court in Warsaw. The former deputy justice minister is said to have been assigned to serve as a judge in the Regional Court for Warsaw.
Onet.pl website found out that employees of the Ministry of Justice, including former deputy justice minister Łukasz Piebiak, have allegedly orchestrated an organised hate campaign waged against judges critical of reforms in the justice system introduced by Law and Justice. After the scandal broke out, Piebiak resigned from office.
Łukasz Piebiak's dismissal also meant that his delegation to the Ministry of Justice had been revoked.
According to the procedure, a judge whose delegation was revoked returns to the court that had delegated him in the first place. In case of Piebiak, it's the Regional Court for Warsaw.
Journalists from TVN24 "Polska i Świat" have managed to access documents saying that the Council of the District Court in Warsaw - institution superior to the Regional Court - has adopted a resolution demanding from the Regional Court's chairman to impose on Łukasz Piebiak an immediate ban on serving as a judge.
The council justifies its demand with "the nature of conduct that the media allege that the judge (Piebiak) has displayed, that led to him being recalled as the Undersecretary of State in the Ministry of Justice, and that call, in the Council's opinion, for immediate banning of the aforementioned judge from serving".
Earlier on Wednesday (September 4), private radio RMF FM informed that the District Court had accepted judge Piebiak's new set of duties proposed by the Regional Court, and that he would return to serving as judge on Thursday.
The Council of the District Court had to issue a positive opinion regarding draft set of duties due to lack of formal obstacles, such as, for instance, disciplinary sentence.
TVN24 journalists have sent questions regarding the issue to the District Court.
The court's press office confirmed that the Regional Court indeed had submitted a request for an opinion regarding judge Piebiak's set of duties, and that a positive opinion had been issued.
