Proceedings carried out so far with the questioned witnesses, including judge Łukasz Piebiak, did not reveal any factual or legal grounds to launch disciplinary inquiries or present disciplinary charges regarding the alleged misconduct - the Disciplinary Spokesperson for the Common Courts Judges, Piotr Schab, said on Friday. He was referring to the hate campaign scandal aimed to discredit certain judges, that was allegedly orchestated by employees of the Ministry of Justice.
The said proceeding pertain to the so-called smear campaign revealed by the media, aimed at discrediting judges critical of the changes made to the justice system by the ruling Law and Justice party, one of them being the chairman of the Polish Judges' Association "Iustitia", Krystian Markiewicz.
The campaign is said to have been orchestrated by employees of the Ministry of Justice, including the then Deputy Minister Łukasz Piebiak. The first reports on the scandal were published in August.
Piebiak stepped down from the office "in a sense of responsibility for the success of the reforms to which he had dedicated four years of hard work". He also announced that he would fight for his good name.
No grounds for inquiry
On Friday, on the website of the Disciplinary Spokesperson for the Common Courts Judges appeared a communique "regarding the stage of explanatory proceedings pertaining to the alleged attempt to publicly discredit the Chairman of SPP "Iustitia", judge Krystian Markiewicz".
Due to high public interest in the stage of the proceedings, the Spokesperson informed that the "proceedings carried out so far with the questioned witnesses, including judge Łukasz Piebiak, did not reveal any factual or legal grounds to launch disciplinary inquiries or present disciplinary charges regarding the alleged misconduct".
"Spokesperson is blind"
The spokesman for the Polish Judges' Association "Iustitia", judge Bartłomiej Przymusiński, commented on the communique issued by the Disciplinary Spokesperson. According to him, judge Schab "fails to see that "Iustitia" judges were receiving anonymous messages, and that one of the KRS (National Council for the Judiciary) members is said to have been approving the content of these messages".
"The Spokesperson is blind in his actions and does not see obvious facts, moreover, I can't see any will in his actions to actually uncover the truth," Przymusiński said.
