Prosecutor General Zbigniew Ziobro has referred a motion to the Constitutional Tribunal regarding the Supreme Court's decision to suspend executing some provisions of the new Supreme Court law - National Public Prosecutor's Office informed on Thursday.
"In Prosecutor General's opinion, sending 5 questions with a request for a preliminary ruling to the Court of Justice of the European Union (CJEU), as well as suspending the execution of some provisions of the new Supreme Court law are flagrant abuses of power," said the National Public Prosecutor's Office.
It also announced that "Polish legal order completely doesn't recognise such action as suspension of executing provisions of binding laws".
Polish Supreme Court (SN) sent five questions to the Court of Justice of the European Union (CJEU) in early August and asked for a preliminary ruling.
The questions concern the provision of the Supreme Court law regarding sending judges aged 65 or older to retirement, including the court's president Małgorzata Gersdorf.
The SN issued a resolution suspending the execution of the questioned law until the CJEU passes its ruling.
Polish Judiciary Council responded with a statement that it's not going to submit to the resolution.
