Incoherent, inconsequential, reaching outside the scope of EU treaties, boils down to protecting pathologies of the Polish justice system - said justice minister and prosecutor general Zbigniew Ziobro, commenting on ECJ advocate general's opinion regarding independence of Polish judiciary.
Minister Ziobro added that, in his opinion, the ECJ might not agree with the advocate general's opinion.
"I think that this opinion was highly incoherent, inconsequential, reaching outside the scope of EU treaties, and it actually boils down to protecting pathologies of the Polish justice system," Ziobro said.
"We fundamentally disagree with this opinion," the justice minister underscored.
The advocate general to the European Court of Justice said on Thursday that a supreme court reform in Poland could undermine the independence of its judiciary, adding pressure on the Warsaw government to row back on changes that EU authorities say threaten the rule of law.
Furthermore, Evgeni Tanchev said the newly-created Supreme Court disciplinary chamber "does not satisfy the requirements of judicial independence under EU law".
The ECJ advocate general's opinion paves the way to the final ruling in a given case. Although, the EU court usually agrees with with the advocate's opinions, it might rule otherwise.
