The Supreme Court sent on Wednesday four questions with request for preliminary ruling to the Court of Justice of the European Union. The questions are identical to those sent by seven Supreme Court judges on 2nd of August, 2018, the Supreme Court's press office told Polish Press Agency (PAP).
As Krzysztof Michałowski from Supreme Court's press team said, the questions pertain "the rule of irremovabilty of judges, independence of courts as rule of EU law, as well as EU law against age discrimination".
"The Supreme Court asked the CJEU to examine the case under an expedited procedure and to add this case the one opened with a request for preliminary ruling on 2nd of August, 2018," Supreme Court's press office informed.
Michałowski also said that the sent questions resulted from a case regarding "determining the existence of employment relationship and remuneration". "A dispute has arisen between an employee - a Polish citizen, and a Swiss company," he added.
On Wednesday, one question out of five has been left out: whether a state of law should be treated as such a fundamental value of the European Union, that a local court should be allowed to suspend executing the local law provisions, that violate the rule of irremovability of judges.
