The Supreme Court (SN) received on Tuesday president's positive opinions regarding five SN judges who had expressed will to continue working for the Polish top court, the SN press office informed Polish Press Agency (PAP).
As Krzysztof Michałowski from SN press office told PAP, the judges who have been allowed to remain Supreme Court's judges are: Marian Kocon (Civic Chamber), Anna Kozłowska (Civic Chamber), Rafał Malarski (Criminal Chamber), Zbigniew Myszka (Labour Law and Social Security Chamber) and Bogumiła Ustjanicz.
According to the new Supreme Court law which came into effect on 3 April, after three months from this date, all judges aged 65 or older were forced to retire. Therefore from 4 July on, in line with the law, they ceased to hold their offices. They might have been allowed to remain at the court, as long as within a month from the new Supreme Court law coming into effect, they had submitted a declaration of will and medical certificate for the president to decide upon.
Before granting or rejecting the requests, the president asked the National Council of the Judiciary (KRS) for opinion. Małgorzata Gersdorf, who is over 65, didn't submit her request to the president.
In July, the KRS issued positive opinions for five Supreme Court's judges, who are over 65 but expressed their will to remain at the court. At the same time, the Council rejected seven judges' requests, including judge Józef Iwulski.
The KRS issued a positive opinion regarding the aforementioned 5 judges: Zbigniew Myszka, Anna Kozłowska, Bogumiła Ustjanicz, Rafał Malarski i Marian Kocon.
Negative assessments were formulated against judges: Józef Iwulskiego (currently the head of the court), Jerzy Kuźniar, Stanisław Zabłocki (all three had not called upon the new Supreme Court law in their statements, but on the Constitution), as well as Maria Szulc, Anna Owczarek, Jacek Gudowski and Wojciech Katner.
