The Supreme Court on Tuesday dismissed as "obviously groundless" the request to revoke Marek F.'s sentence filed by his attorneys, which means that the legally binding verdict of 2.5 years in prison, issued by the court of second instance, became final.
In the sentence justification, judge Zbigniew Puszkarski stressed that the Supreme Court did not share the defence' argumentation, according to which the court of second instance is said to have blatantly violated the rules of conduct.
The so-called wiretap scandal was one of the high-profile cases in recent years. The recordings published in the media in 2014 sparked off a crisis in Donald Tusk's cabinet. The case pertained to private conversations between business figures and politicians that had been secretly recorded in two Warsaw restaurants throughout 2013 and 2014. Marek F. has been unconditionally sentenced for prison.
In the last week's session the Supreme Court recognized the defence' request for cassation, in which the court of second instance was said to have "blatantly violated the principles of conduct". The defence called for acquittal due to "obviously wrongful conviction", or alternatively for reopening the case.
The legally binding verdict in this case was issued by the Court of Appeals in Warsaw in December 2017. The court upheld the sentence passed in 2016 by the Warsaw District Court, deeming its findings as valid. Later on, the Court of Appeals rejected complaints by Marek F.'s attorneys who had demanded the punishment to be postponed due to the defendants poor health.
Marek F. was to report in prison on February 1 of this year, but he was hiding. A European Arrest Warrant was issued after him. On April 5, the businessman was detained in Spain and taken back to Poland, where he was placed in prison.
