The head of the VAT fraud investigative commission, Marcin Horała (Law and Justice), proposed in his draft report to refer former prime ministers Donald Tusk and Ewa Kopacz, as well as former finance ministers Jacek Rostowski and Mateusz Szczurek, to the State Tribunal.
Horała wrote in the substantiation: "Donald Tusk, with all certainty should have had knowledge about of the leaky tax system and the ever widening tax loophole. Official documents from the Ministry of Finance, European Commission reports, as well as calls from industries mostly affected by the malpractice, all point to this fact".
"Donald Tusk, as the head of the government, was referring draft legislation regarding VAT, which under the guise of removing unnecessary administrative obstacles, were loosening the tax system, and later on, he did not initiate legislative work that in other EU countries led to reduce tax fraud," Horała wrote.
Horała also claims that similar charges can be addressed to the Tusk's successor, former PM Ewa Kopacz. "The reforms proposed by Ewa Kopacz's cabinet were only fragmentary, rather than systemic, and were introduced with significant delay," reads the draft report.
In Horała's view, both former prime ministers are guilty of negligence by failing to set organised tax fraud as the top priority task for the Central Anti-Corruption Bureau (CBA).
Furthermore, the head of the VAT fraud investigating committee wants to put former finance ministers Jacek Rostowski and Mateusz Szczurek before the State Tribunal.
He added that the Constitution provides the possibility of "a member of the government to face the State Tribunal for committing offences in connection to the held office".
The VAT fraud investigative commission was summoned in the beginning of July, 2018, in order to examine and assess the correctness of the Civic Platform - Polish People's Party coalition government's policy regarding the VAT revenue and excise duty, as well as possible negligence in that regard. The period in question dates back to December, 2007, until November, 2015.
