PiS leader Jarosław Kaczyński announced on Tuesday in the Sejm that his party would appeal the State Electoral Commission’s (PKW) decision to the Supreme Court. The PKW yesterday rejected PiS's 2023 financial report, which could result in the party losing its public funding for three years under Polish political party laws.
Asked by a TVN24 reporter in the Sejm whether PiS would appeal the decision, Kaczyński replied: "Of course we will, but the National Electoral Commission, specifically its representative Ryszard Kalisz, stated they won’t abide by court rulings. We are living in a state of complete anarchy, a sort of dictatorial anarchy."
The head of the PKW, Sylwester Marciniak, said on Monday that PiS has the right to file a complaint with the Supreme Court within seven days. The court is expected to resolve the matter within 60 days.
Ryszard Kalisz, a member of the PKW, explained on Monday that the commission also passed a resolution in three parts. It called on state authorities, especially the Sejm, to address legal and constitutional chaos regarding the so-called "neo-judges" (judges appointed by Poland's judiciary council, whose members had been nominated by politicians under PiS government).
The PKW declared it would not recognize any rulings from individuals who are not judges and specifically stated that it would not accept decisions from the Supreme Court’s Extraordinary Control and Public Affairs Chamber.
Rejected financial reports
The PKW previously rejected PiS’s financial report for the 2023 parliamentary elections, citing irregularities amounting to 3.6 million złoty in campaign funding. Monday’s rejection was based on similar grounds, according to the State Electoral Office (KBW) press secretary, Marcin Chmielnicki.
In early September, PiS appealed the August decision to the Supreme Court, claiming it was made "entirely in violation of the law." The court has yet to rule on that appeal.
