"Until the President recognizes the opinion of the National Judiciary Council (KRS), Józef Iwulski and Stanisław Zabłocki remain active judges," said the former First President of the Supreme Court, Professor Adam Strzembosz in TVN24's "Tak jest".
On Thursday, the new KRS negatively verified, among others, two Supreme Court judges who submitted statements of will to remain active.
"They observed the law. They didn't point to those provisions of the law that are unconstitutional," Professor Strzembosz said about the judges.
The new National Judiciary Council proceeded over the statements of judges that want to remain in the Supreme Court after entering retirement age. According to a new Supreme Court law, judges who have reached the age of 65 were forced to retire.
The spokesperson for the National Judiciary Council, Maciej Mitera announced that judges: Zbigniew Myszka, Anna Kozłowska, Bogumiła Ustjanicz, Rafał Malarski oraz Marian Kocon have been positively verified by the KRS. He added that remaining judges, Jerzy Kuźniar, Maria Szulc, Anna Owczarek, Stanisław Zabłocki, Jacek Gudowski i Wojciech Katner have received negative opinions.
Mr Mitera said that the decision will be annouced in a form of a resolution. Judge Iwulski is currently filling in for the First President of the Supreme Court, Małgorzata Gersdorf. She has named him as her stand-in while she's away on vacation.
Judge Iwulski is among the seven judges who, although being 65 or older and submitting the statement of will to remain in the Supreme Court, did not attach the required health condition certificate.
