The National Council of the Judiciary (KRS) has thanked the President for vetoing the bills on the Supreme Court and the KRS. The Council has also upheld its declaration of cooperation in the design of new legislative proposals on the functioning of the judiciary.
The resolution expressing gratitude to President Andrzej Duda says: “The National Council of the Judiciary emphasizes that in the relations between the executive and the judiciary, core executive powers are vested in the President of the Republic of Poland, rather than in the Minister of Justice Prosecutor General.”
The KRS has also upheld its declaration of cooperation with the President in the design of new judiciary legislation proposals.
KRS says thank you to citizens
In its second resolution, the KRS thanked the Poles who stood by the core constitutional values and took a firm stance to defend them.
It expressed gratitude to “all citizens who, in the recent days, stood by the core values enshrined in the Constitution, such as freedom, equality, human dignity and independence of the judiciary, taking a firm stance to defend them”.
It was stressed that “We are all committed to ensuring that (...) everyone has the right to a fair and public hearing of his case, without undue delay, before a competent, impartial and independent court”.
“The right to justice serves as a primary means of protection of all human and citizen rights and freedoms, and a mature civil society must be inherently ready to defend those rights and freedoms when they are endangered. The National Council of the Judiciary believes that in civil society, courts must always be open to hear the voice of the Citizens”, the resolution continues.
Two vetoes by the President
The President announced on Monday that he decided to veto two bills: on the Supreme Court and on the National Council of the Judiciary. He argued that it had never been part of the tradition that the public prosecutor general could interfere in the proceedings of the Supreme Court in any manner. “I am making this decision with an immense sense of responsibility for the Polish State”, he declared.
The President additionally announced that bills on the Supreme Court and the KRS would be drawn up within two months. “The bills have to be adjusted so that they are acceptable to everyone”, he said on Monday.
