I'm absolutely certain that, de jure, I'm still an active Supreme Court's judge; the legal provisions which the president invokes are not in line with the Constitution, said judge Stanisław Zabłocki in Thursday's edition of TVN24's "Kropka nad i".
On Wedensday, the Supreme Court received president's formal letters to seven judges, informing about their retirement starting on 12 September.
President's letters concern seven judges who are 65 and whose requests to remain at the court were rejected by Andrzej Duda. Those judges are: Józef Iwulski, Jerzy Kuźniar, Stanisław Zabłocki, Maria Szulc, Anna Owczarek, Jacek Gudowski and Wojciech Katner.
Earlier on, all of the above received negative opinions from the National Council of the Judiciary.
Asked in TVN24, if he agrees with the president's decision to send seven judges to retirement, judge Zabłocki said: "I'm absolutely certain that, de jure, I'm still an active Supreme Court's judge, because I have the deepest conviciton that the legal provisions which the president invokes are not in line with the Constitution".
"My own conviction that, de jure, I'm still an active judge is one thing, however, the reality is that I've been handed a retirement letter," said the judge.
Asked if the document should be countersigned by the president, he confirmed that it should.
Zabłocki also said that he had counted on the president to accept his standpoint and to let him remain a Supreme Court's judge.
