Belgian authorities informed that 10-year-old Ibrahim was safe and sound. The boy is under the care of his father, and any further steps would be taken only by a court. The Child Alert procedure has been therefore called off - Polish police informed on Tuesday.
The Child Alert was launched on Monday at 6:45am. The 10-year-old Ibrahim was reported missing by his mother. Her former partner and father of Ibrahim was being suspected of abducting the boy. The mother claimed the man had lost the parental rights.
Belgian authorities have informed that according to the last court ruling from 2018, the boy was to remain in Belgium with his father, which would mean the mother broke the law by taking him to Poland.
Deputy Minister of Justice Michał Wójcik informed on Tuesday he sent a letter to Belgian justice minister in which he asked for help in determining the legal status of Ibrahim.
"As Poland's deputy justice minister I am concerned with the whole situation, which is amplified by contrasting statements regarding parental rights" - Mr Wójcik wrote.
He also said the National Public Prosecutor's Office has asked its Belgian counterpart for information regarding all rulings passed in this case. "What we have so far are media reports. And we need to work with documents" - deputy minister said.
Furthermore, he informed the mother of Ibrahim has contacted the Ministry of Justice and explained the chronology of events to a departament chief responsible for this case.
"We must ascertain how it was possible to have two contradicting rulings regarding the parental rights over the child, because the mother mentioned some other ruling which, to my knowledge, is at the prosecutor's office. The Belgian prosecutor's office, however, said there had been another ruling. We cannot really figure out how this could have happened. That's why we need to carefully examine all documents" - he stressed.
The deputy minister also asked the Polish consul in Belgium to provide the mother of Ibrahim with any help should she needed it.
"We care about the child's wellbeing. The conflict between the mother and the father of the boy is of secondary importance to us. It's crucial nothing happens to this child" - Mr Wójcik added.
The mother of the boy, Karolina Delkiewicz, went to the police station in Antwerp on Tuesday.
"The officers told me they wouldn't look into the case, as according to the last ruling from October 2018, both parents share parental rights, but the court set the permanent residence of the boy under his father's address" - the woman told Polish Press Agency.
She said she would provide Belgian justice system with materials regarding abduction attempt from 2019, as well as attack and abduction from last Sunday.
In Poland the case is being examined by the Regional Prosecutor's Office in Gdynia.
