Poland is ready to defend its systemic approach and legal standpoint before the Court of Justice of the European Union; decision by the European Commission wasn't a surprise and we will issue our statement on the complaints and motions, as soon as the CJEU sends us documents, the spokesperson for the government, Joanna Kopcińska commented on the EC's
The European Union sued Poland on Monday in the EU's highest court over its ruling party's changes to the judiciary, which the bloc believes violates the independence of the courts.
"The European Commission maintains that the Polish law on the Supreme Court is incompatible with EU law as it undermines the principle of judicial independence, including the irremovability of judges," the EU's executive Commission said in announcing the move.
"Today's decision by the European Commission wasn't a surprise. Dispute between Warsaw and Brussels regarding the Supreme Court law's compability with EU treaties has been going on for months. We have underscored out position on this matter on numerous occasions in recent months," said the spokesperson for the government.
"We will issue our statement on the complaints and other motions by the European Commission, as soon as teh CJEU sends us documents, in line with the procedure," she added.
Kopcińska underscored that in regard to the temporary preventive measures, for which the EC is asking, "it's necessary to point out that those can only apply to future events, that would obstruct carrying out a ruling".
"Only a legally binding ruling by the CJEU can force a member-state to change its legislation," said the spokesperson for the Polish government.
"Poland is ready to defend its systemic approach and legal standpoint before the CJEU," Joanna Kopcińska reassured.
