Germany is to hand over Łukasz Ż. to the Polish authorities on Thursday (November 14) around noon - according to Piotr Antoni Skiba, spokesperson for the District Prosecutor's Office in Warsaw. Łukasz Ż. is suspected of causing a fatal accident on Trasa Łazienkowska in September.
Łukasz Ż. will be transferred to Poland based on the approval of a German court as part of the European Arrest Warrant (EAW) procedure. He is suspected of causing a fatal accident on Trasa Łazienkowska in September. He was detained at a hospital in Lübeck, north Germany.
According to the prosecutor's office, Łukasz Ż., who caused the accident while driving a Volkswagen Arteon and then fled the scene, is suspected of causing a road accident, driving under the influence of alcohol, and violating court-imposed penalties.
He faces a sentence ranging from 9 months to 12 years in prison.
Assistance in escape
Three other men—Mikołaj N., Damian J., and Maciej O.—were detained at the scene of the accident.
"As witnesses to the road accident, they failed to assist the victims and additionally obstructed the investigation by helping Łukasz Ż., the perpetrator of the accident, to evade criminal responsibility. They initiated and assisted in his escape," said Prosecutor Piotr Antoni Skiba.
They have been charged with failing to provide assistance and being accessories to the crime. They face three to five years in prison. The men had been arrested for three months.
Łukasz Ż. had been repeatedly convicted for driving under the influence of alcohol, driving without a license, fraud, and possession of drugs. Last year, he was banned from driving all motor vehicles.
A tragic death
The accident occurred on the night of September 14-15 on the eastbound lane of Trasa Łazienkowska near the Torwar sports hall. The Volkswagen, presumably driven by Łukasz Ż., crashed into the rear of a Ford, which then hit the traffic barriers.
The Ford was carrying a family of four. A 37-year-old passenger of the car, a husband and father, was killed. Three people from the Ford were taken to the hospital: the 37-year-old female driver and two children, aged four and eight. A woman who was traveling in the Volkswagen was also transported to the hospital.
