The Court of Justice of the European Union on Thursday rejected an appeal by Germany against the top court's ruling regarding the OPAL pipeline, connected to the Nord Stream. The decision effectively limits Gazprom's access to the pipeline.
The CJEU rejected an appeal filed by Germany against a ruling from 2019, in which the high court had overruled a decision by the EU Commission granting Gazprom monopoly on operating the OPAL.
"Poland wins the dispute over OPAL gas pipeline! The Court of Justice of the European Union has ruled that the European Commission violated the principle of energy solidarity by issuing a decision on the OPAL gas pipeline" - Poland's state-run gas operator PGNiG said on Twitter.
The EU executive's decision from 2016 was challenged by Poland, that argued it infringed on EU rules on energy security, as it could make the bloc more dependent on Russian gas.
Germany argued that "energy solidarity" was not a legal issue, but a more of a political concept.
The EU Court of Justice dismissed this argumentation and stressed that the EU Commission should take potential security risks into account when dealing with energy supply issues.
