"According to the constitutional law, there can be no doubt that Professor Gersdorf holds an office from which she cannot be recalled," said the former President of the Constitutional Tribunal, Professor Andrzej Rzepliński in TVN24 "Tak jest".

"According to the constitutional law, there can be no doubt that Professor Gersdorf has been assigned to an office from which she cannot be recalled," said Professor Andrzej Rzepliński.
"Furthermore, it should also be noted that one the provisions states that judges are irremovable. Even a law passed with full support both houses of parliament and immediately after signed by the president, cannot shorten Supreme Court President’s tenure," he added.
Asked about Prime Minister Morawiecki's statement that judge Gersdorf isn't Supreme Court's head anymore, Professor Rzepliński replied: "how can I rely on Mr Morawiecki's judgement when not only he isn't a jurist, but he's also a mediocre historian".
"I've spent almost whole day today on reading the latest draft amendment to Supreme Court law. It includes 112 changes. If the parliamentary commission had spent 10 minutes on each of those changes than it would take about 19 hours without any breaks," said Rzepliński.
Normal to come to work
"Back in the times when Lech Wałęsa was president, or even earlier, in the times of general Jaruzelski, impotant changes to judiciary laws were being prepared by jurists in the President's Chancellery, withoun any haste. Only then the President decided whether or not to submit the new law in the Sejm where eventually it was being discussed. Same procedure applied to acts on the Supreme Court, National Council of the Judiciary and the Constitutional Tribunal," he added.
"It would be rather strange if the head of a constitutional institution, such as the Supreme Court, wouldn't show up at work on a regular basis. With the exception of vacation time, of course," said former head of Constitutional Tribunal.
"I find it absolutely normal that judge Gersdorf is showing up in the Supreme Court. After all she's its President," said Professor Andrzej Rzepliński.
