There is no bill aimed at liquidating the Disciplinary Chamber of the Supreme Court - deputy spokesman of the ruling PiS party Radosław Fogiel told TVN24. PiS chairman Jarosław Kaczyński said in last year that the chamber, which is a "matter of dispute" with the EU, would be dismantled."We've been talking about continuation of the general overhaul of the justice system, rather than liquidating this, or any other chamber," Fogiel argued on Monday.
In October, 2021, Poland has been ordered by the Court of Justice of the European Union to pay a penalty of 1 million euro daily for not complying with the EU court's ruling, telling Poland to dismantle the Disciplinary Chamber of the Supreme Court. Despite the ruling and the imposed fines, the chamber still operates and issues verdicts.
"Brussels claims it has imposed a penalty on us. Based on the treaties signed by Poland, we firmly think that the justice system is not among the competences delegated to the European Union," deputy spokesman of the ruling PiS party Radosław Fogiel told TVN24 on Monday.
Fogiel: there's no bill liquidating Disciplinary Chamber and no one ever said there was
Fogiel was also asked when the Disciplinary Chamber would be dismantled, which had been announced by Jarosław Kaczyński in August of 2021. "We will liquidate the Disciplainry Chamber in its current form and this will move the matter of dispute out of the way. (It will happen - edit.) in September, it will be a government initiative. It will change the legal codes, so it will have to be done in a longer procedure. It's all about the specific shape of the Disciplinary Chamber, but it doesn't mean that this Chamber will cease to exist in any form," PiS chairman said at last year. Also other members of the ruling coalition spoke about plans to dismantle the contested chamber, including prime minister Mateusz Morawiecki.
On Monday, Fogiel said "there is no bill, no one ever claimed there was, and no one said anything about any bill liquidating the Disciplinary Chamber".
"For some time now, we've been talking about continuation of the general overhaul of the justice system, rather than liquidating this, or any other chamber. Indeed, as part of this reform there will also be changes in the disciplinary system for judges, a very important element for the functioning of the judiciary. However, it will be carried out only after a complete agreement between interested parties has been reached, and certainly not dictated by anyone," he stressed.
He repeated that "there's no bill aimed at liquidating this, or any other chamber".
